The IGNSS Association of Australia (” the Association”) is the owner of this website (http://www.ignss.org.au). A reference to “you” in these terms and conditions means all visitors to the Web Site, including Members of the Association. The Web Site is offered to you conditional on your acceptance of these terms and conditions. Your use of the Web Site constitutes your agreement to these terms and conditions. If you do not accept these terms and conditions you should immediately cease using the Web Site.

MODIFICATION OF THESE TERMS OF USE
The Association reserves the right to change these terms and conditions, without prior notice to you. You should review this page when re-visiting the Web Site as your continued use of the Web Site will indicate your acceptance of any changes to these terms and conditions.

The Web Site may contain links to other Web Sites (“Linked Sites”). The Linked Sites are not under the control of the Association and the Association is not responsible for the contents of any Linked Site. The inclusion of any Linked Site does not imply endorsement by the Association with its operators.

THIS WEBSITE IS PROVIDED “AS IS”
Access to the Web Site is given to you on an “as is” basis. The Association does not warrant that access to the Web Site will be uninterrupted or error free or that the Web Site or the server are free of viruses or other harmful components. The Association does not guarantee against third party interference nor that the Web Site will be compatible with third party software or hardware.

DOCUMENTS STORED ON THIS SITE AUTHORED BY THIRD PARTIES
The contents of conference papers and proceedings on this site is produced by the individual authors as named on each document. They do not represent the thoughts and opinions of the IGNSS Assosciation, nor its executive officers, unless otherwise named as an author/co-author of said document. Reproduction or republication of works hosted on this website, whether in part or in full, must not be done without first gaining written permission from both the Website Owner and the author/s of said work.

NO UNLAWFUL OR PROHIBITED USE
As a condition of your use of the Web Site, you warrant that you will not use the Web Site for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the Web Site in any manner which could damage, disable, overburden, or impair the Web Site or interfere with any other party’s use and enjoyment of the Web Site. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Web Site.

Members who have access to the Association Member Pages agree to use the content available in both the Web Site and the Member Pages in good faith and without intention to bring disrepute or reputational damage to the Association.

The following behaviour is prohibited. You may not use the Web Site in a way that is:
· fraudulent;
· unlawful;
· invasive of another’s privacy;
· infringes the intellectual or other proprietary interests of third parties;
· facilitates the distribution of viruses or other harmful components that are designed to interrupt, destroy, change or limit the functionality of the Web Site, or any other computer software, hardware or other electronic equipment;
· using or launching any automated system to access other user’s systems or data;
· collecting information for the benefit of yourself or another party;
· plagiaristic, or
· encouraging any other person or entity to engage in any of the above.

LICENCE TO YOU
The Association grants you this licence to use the Web Site for personal use and information source, and for Members to obtain resources (“the Purpose”). This is a non-exclusive, revocable licence to use the Web Site and all of its content (“Intellectual Property”) for the Purpose. The Association represents and warrants to you that it has the right to licence the Intellectual Property to you and that your use of Intellectual Property in accordance with these terms will not infringe the rights of any third party. You cannot assign or sub-licence this licence. You acknowledge that the Association is the absolute owner of all rights in the Intellectual Property and that ownership of the Intellectual Property remains vested with the Association. You must not alter, remove or obscure any copyright or trade mark symbol or legend or other property mark on any content provided by the Association.

You may only use the Intellectual Property for the Purpose. This is an essential term which survives termination of this agreement. You must ensure that all copies of any Intellectual Property made, printed, published or reproduced by you, including in electronic form, will bear whatever proprietary statement is required by us. You undertake to ensure that the Intellectual Property is not subjected to any treatment that is prejudicial to our reputation or that infringes our moral rights. If you become aware of any conduct which is prejudicial to our rights in the Intellectual Property you must immediately provide written notice to us of this conduct including all details available.

You are not permitted to sell, charge, mortgage or otherwise encumber the Intellectual Property in any way. You are not permitted to claim or hold yourself out, engage in any conduct or make any representation the effect of which would suggest that you are our agent. The Association indemnifies and holds you harmless from and against any loss, liability, cost or expense that you suffer directly or indirectly because of any claim by a third party of rights in the Intellectual Property. You indemnify and will hold the Association harmless and you promise to keep the Association indemnified against any loss, claim, action, settlement, award, judgement, expense or damage of whatsoever kind or nature and howsoever arising that the Association might suffer as a result of any use of the Intellectual Property by you.

LIMITED LIABILITY
Without limiting the operation of the Australian Consumer Law, the Association excludes all conditions, warranties, terms and guarantees otherwise implied by law. The Association is not liable for any misuse of the Program by you. To the extent permitted by law the Association is not liable to pay for any indirect, economic, special or consequential loss or damage including but not limited to loss of revenue, profit, goodwill, business or claims made against it arising from your use of the Web Site and the Intellectual Property.

INDEMNITY
You agree to indemnify keep the Association fully indemnified against all claims by any person whatsoever for injury, loss or damage suffered in connection with your use of the Web Site where the claim arises from your breach of these terms and conditions.

BREACHES OF THESE TERMS AND CONDITIONS
The Association reserves the right to take any of the following action if we reasonably suspect that a breach of these terms and conditions has occurred:
(a) issue a formal warning;
(b) suspend or prohibit access to the Program;
(d) block access to the Program and/or Facebook group;
(f) take legal action against you,
(g) suspend or delete your account, and
(h) report a matter to law enforcement.
If we suspend or prohibit or block your access to the Web Site, action taken by you to circumvent suspension or prohibition or blocking will be considered as a further breach of these terms and conditions.

GENERAL
If any provision of this Agreement is invalid under any law the provision will be deleted from the Agreement to the extent of the invalidity and the remaining provisions will remain in full force and effect. This Agreement shall be governed by and construed in accordance with the laws of New South Wales and Australia and any claim arising out of this Agreement will be determined in New South Wales.

TERMINATION / ACCESS RESTRICTION
The Association reserves the right, in its sole discretion, to terminate your access to the Web Site and the related services or any portion thereof at any time, without notice.
